Introduction

The following are the General Terms and Conditions of FC Mystery. These terms apply whenever you use or place an order through our website. These conditions contain important information for you as a customer. Please read them carefully. We recommend saving or printing these terms so that you can review them later.

Article 1 – Definitions

1.1 FC Mystery: Located in Nieuwegein and registered with the Chamber of Commerce under registration number 96464682, trading under the name FC Mystery. 1.2 Website: FC Mystery’s website, accessible via www.fcmystery.com and all associated subdomains. 1.3 Customer: The natural person who is not acting in the exercise of a profession or business and enters into an agreement with FC Mystery and/or has registered on the Website. 1.4 Agreement: Any arrangement or contract between FC Mystery and the Customer, of which these General Terms and Conditions form an integral part. 1.5 General Terms and Conditions: These present General Terms and Conditions.

Article 2 – Applicability

2.1 These General Terms and Conditions apply to all offers, agreements, and deliveries by FC Mystery, unless otherwise agreed upon in writing. 2.2 Deviating conditions stipulated by the Customer are only binding if accepted by FC Mystery in writing. 2.3 If, in addition to these General Terms and Conditions, specific product or service conditions apply, the most favorable provision for the Customer shall prevail in case of contradiction.

Article 3 – Prices and Information

3.1 All prices on the website include VAT and other government levies. 3.2 Any shipping costs will be clearly stated before the Agreement is concluded. 3.3 FC Mystery strives for careful provision of information but reserves the right to correct manifest errors. 3.4 Deviations in color and form may occur due to screen settings; FC Mystery is not liable for this.

Article 4 – Conclusion of the Agreement

4.1 An Agreement is concluded upon the acceptance of the offer and the fulfillment of the stipulated conditions. 4.2 FC Mystery will immediately confirm electronic acceptance via email. 4.3 In the event of incorrect data, delivery may be suspended until correct information is received. 4.4 FC Mystery may assess whether the Customer can meet their payment obligations. If in doubt, an order may be refused or executed under specific conditions.

Article 5 – Registration

5.1 Registration may be required for optimal use of the Website. 5.2 The Customer chooses their own username and password and is responsible for their secure storage. 5.3 FC Mystery is not liable for the misuse of login credentials. 5.4 If misuse is suspected, the Customer must immediately change the password and contact FC Mystery.

Article 6 – Execution of the Agreement

6.1 Orders will be shipped as quickly as possible, within the specified term. 6.2 FC Mystery may engage third parties for the execution of the Agreement. 6.3 The standard delivery time is a maximum of five working days within the Netherlands and Belgium. 6.4 In case of delay, the Customer will be informed, with the possibility of dissolving the Agreement. 6.5 The Customer is advised to check products immediately upon receipt. 6.6 The risk of damage or loss passes to the Customer upon delivery at the delivery address. 6.7 If an ordered product is unavailable, a comparable product may be delivered. In this case, the Customer is entitled to cancel and return the product free of charge.

Article 7 – Right of Withdrawal (Returns)

7.1 This article applies only to consumers (non-business customers). 7.2 You have the right to withdraw from the Agreement within 30 days without giving any reason. 7.3 The withdrawal period starts on the day of receipt of the (last) product. 7.4 Return costs are borne by the Customer. 7.5 Products may only be unpacked/used to the extent necessary for inspection, as would be possible in a store. 7.6 Damage resulting from use beyond what is permitted may be deducted from the refund. 7.7 Withdrawal can be done via the model form or by email to info@fcmystery.com. After notification, you have another 14 days to return the product. 7.8 Refunds will be made within 14 days after dissolution using the same payment method, unless FC Mystery is waiting for receipt of the product or proof of return. 7.9 Information about the right of withdrawal is clearly stated on the website beforehand.

Article 8 – Payment

8.1 Payment is made via the methods offered during the ordering process. 8.2 Post-payment (pay later) is not possible at FC Mystery.

Article 9 – Warranty and Conformity

9.1 This article applies only to consumers. 9.2 FC Mystery guarantees that products comply with the Agreement, the description, and reasonable usage expectations. 9.3 Any factory warranties do not affect statutory rights. 9.4 Complaints about defects must be reported in a timely manner. 9.5 In the event of legitimate complaints, the product will be repaired, replaced, or reimbursed (up to the purchase amount), at FC Mystery’s discretion.

Article 10 – Complaints

10.1 Complaints can be submitted by email, phone, or post. 10.2 A response or acknowledgment of receipt with an estimated response time will follow within 2 working days. 10.3 Consumers can also submit complaints via the EU platform: http://ec.europa.eu/odr/

Article 11 – Personal Data

11.1 FC Mystery processes personal data in accordance with the privacy policy stated on the website.

Article 12 – Final Provisions

12.1 Dutch law applies to this Agreement. 12.2 Disputes will be submitted to the competent court in the district of FC Mystery (Nieuwegein). 12.3 If any provision is deemed invalid, the remaining terms and conditions shall remain in force. 12.4 “In writing” also includes communication by email, provided identity and integrity are established.
